Background

These terms and conditions (the "Terms") apply between you, the user of this website ("you", "User"), and MB „Autou", company code 307461736, registered office Kontininkų g. 3B K8, LT-00171 Palanga, Republic of Lithuania ("we", "us", "AutoUniverse"), the owner and operator of the website autouniverse.eu (the "Website"). By accessing or using the Website you agree to be bound by these Terms. If you do not agree, you must stop using the Website immediately.

1. Definitions

  • "Account" – the personal information and credentials (e-mail address and password) used by a User to log in to the Website and to create Adverts.
  • "Advert" – an advertisement for a vehicle, part, accessory or other item placed on the Website by a User.
  • "Private seller" – a natural person selling their own items outside of a business activity.
  • "Trade seller" – a company or a person acting in the course of a business (a dealer).
  • "Plan" – an advert package or a single-advert service offered on the Website for a price shown on the Advert fees page.
  • "Advert credit" – the right, obtained by purchasing a Plan, to publish one Advert for the period of validity defined by that Plan.
  • "Content" – any text, photographs, videos, prices, contact details and other material submitted to the Website by a User.

2. The service

The Website is an online marketplace where Users publish Adverts and buyers browse them and contact sellers directly. AutoUniverse is not a party to any sale. We do not own, inspect, store or deliver the items advertised, we do not take part in negotiations or payments between buyers and sellers, and we do not guarantee the accuracy of any Advert or the identity, solvency or good faith of any User. Any contract of sale is made solely between the buyer and the seller.

3. Accounts and registration

  1. To place an Advert you must register an Account with a valid e-mail address and confirm it by clicking the verification link we send you. Accounts that are not verified within 5 hours are deleted automatically.
  2. You must be at least 18 years old and legally able to enter into contracts.
  3. You must provide true, accurate and current information and keep it up to date. Trade sellers must register as trade sellers and must provide their company name.
  4. You are responsible for keeping your password secret and for all activity on your Account. Tell us immediately at infoautouniverseeu@gmail.com if you believe your Account has been used without your permission.
  5. One person or company may hold only one Account. The free "Basic" Plan may be used only once per person.

4. Placing adverts

  1. Each Advert may describe one item (or one set of identical items, e.g. a set of tyres) that you own or are legally entitled to sell, located in one of the countries of the European Union.
  2. Adverts must be placed in the correct category, must be written in English, must contain an accurate description, a real price and photographs of the actual item offered. Stock photos, photos of other items, watermarks or contact details placed on photographs are not permitted.
  3. The following are not allowed: duplicate Adverts for the same item; Adverts for items that are not for sale; Adverts for services, or items unrelated to vehicles and transport; stolen, counterfeit or illegal items; misleading, offensive, discriminatory or defamatory content; links to other classified websites; any content that infringes the rights of third parties or applicable law.
  4. An Advert is published for the period of validity of the Plan used (for example 90 days, or 30 days for VIP). After that it expires and is hidden from the Website. You may prolong an Advert before or after expiry using an Advert credit. You may edit, deactivate or delete your Adverts at any time from your account.
  5. You grant us a non-exclusive, royalty-free, worldwide licence to store, reproduce, display and adapt (e.g. resize) the Content you submit, for the purpose of operating and promoting the Website, for as long as the Advert is stored on the Website.
  6. Anyone may report an Advert that they believe breaks these Terms. We may check Adverts and reports but we are not obliged to monitor Content.

5. Plans, prices and payment

  1. The current Plans and prices are listed on the Advert fees page. All prices are in euro (€). We may change Plans and prices at any time; changes do not affect Plans already paid for.
  2. Payments are made online by payment card through our payment service provider (Revolut). We do not receive or store your card details. A Plan is activated immediately after the payment is confirmed by the payment provider.
  3. Advert credits purchased in a Plan are valid for 365 days from the date of purchase. You must use these ads during one year – we will remove unused ads after one year from your account without a refund! The number of unused credits and their expiry date are shown in your account.
  4. Plans are services with digital content that begin immediately after purchase. By paying for a Plan you expressly agree that the service starts at once and acknowledge that you lose the right to withdraw from the contract within 14 days once the service has started. Purchased Plans, Advert credits and single-advert services are therefore non-refundable, except where required by law or where we fail to provide the service paid for.
  5. An invoice or payment confirmation is sent to your e-mail address and is available in your account.

6. Intellectual property

All content of the Website that is not User Content – including the design, logos, texts, software, databases and the arrangement of Adverts – is owned by or licensed to AutoUniverse and is protected by copyright and other intellectual property laws. You may view, print or download pages for your own personal, non-commercial use only. Copying, scraping, reproducing or republishing Adverts or any other part of the Website, in whole or in part, by automated means or otherwise, is prohibited without our written consent.

7. Third-party content and links

The Website may contain advertisements (including advertisements served by Google AdSense), embedded YouTube videos and links to other websites. These are provided for your convenience only. We have no control over such websites or content and accept no responsibility for them. Their own terms and privacy policies apply.

8. Termination and suspension

  1. We may remove or edit any Advert, and suspend or close any Account, without notice and without refund, if we reasonably believe that you have breached these Terms, the law, or the rights of others, or if your Account is used for fraud, spam or abuse.
  2. You may close your Account at any time by contacting us. Adverts and unused Advert credits are removed when the Account is closed and are not refunded.

9. Availability and changes

We aim to keep the Website available at all times, but we do not guarantee uninterrupted or error-free operation. We may suspend the Website for maintenance and may change or discontinue any feature of the Website at any time. We may update these Terms from time to time; the current version is always published on this page and applies from the date of publication. If you continue to use the Website after a change, you accept the changed Terms.

10. Disclaimer and limitation of liability

  1. The Website and its content are provided "as is". We give no warranty that Adverts are accurate, complete or lawful, or that a User is who they claim to be. Buyers should always inspect an item and verify the seller and the documents before paying.
  2. To the fullest extent permitted by law, AutoUniverse is not liable for any loss or damage (including loss of profit, loss of data or indirect loss) arising from the use of or inability to use the Website, from any Advert or Content, or from any transaction between Users.
  3. Our total liability to you for any claim relating to the Website is limited to the amount you paid us for Plans in the 12 months preceding the claim.
  4. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including the mandatory rights of consumers under the law of the Republic of Lithuania and of the European Union.

11. Privacy

We process personal data in accordance with our Privacy & cookie policy, which forms part of these Terms. Contact details published in an Advert are visible to all visitors of the Website; by publishing them you consent to their display for the purpose of being contacted about the Advert. Using contact details from Adverts for any other purpose (marketing, spam, data collection) is prohibited.

12. Communications

We will contact you by e-mail at the address registered in your Account (e.g. account verification, password reset, payment confirmations, advert expiry notices). You may contact us at infoautouniverseeu@gmail.com.

13. General

  1. If any provision of these Terms is found to be invalid, the remaining provisions remain in force.
  2. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
  3. These Terms are the entire agreement between you and us regarding the use of the Website and replace all previous terms.
  4. These Terms are governed by the law of the Republic of Lithuania. Any dispute shall be settled by the competent courts of the Republic of Lithuania, without prejudice to the right of consumers to bring proceedings in the courts of their country of residence. Consumers in the EU may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
